Ask where in the universe the least observation has been made, and the mind travels outward. It is the wrong direction. The least observed place is not distant. It is beneath the foot.

This essay argues that the same inversion governs the law; that the instrument by which a citizen observes the norm is fashioned by the party whose acts it displays; and that this arrangement guarantees a permanent condition which I will name exactly — reflection without fusion. Seeing, forever, and never knowing.
I. The unobserved is underfoot
The instinct to look outward is not stupidity; it is the structure of instruments. An instrument is built to reach what the body cannot. Nothing is built to reach what the body is already standing on, because standing on a thing is mistaken for knowing it.
Transpose this to the norm, and the mapping is exact. A citizen asked which rules are least known to him will think of the exotic ones — mining law, maritime law, the codes of trades he will never practise. He is wrong in the same direction as the astronomer. The rule least known to him is the municipal order of the commune he is crossing at this moment: the prohibition on bathing, on lighting a fire, on gathering, on walking a particular strip of ground because a shaft was sunk there a century ago and never properly closed.
These are the norms that will actually reach him, and they are the ones no register holds. In France, the great consolidated corpus — some forty-eight million words of statute and decree³ — excludes local acts entirely. There is no consolidated base of them. The law applicable to a given point of the territory cannot be queried by anyone, including the State that made it.
The unmapped zone is not the far one. It is the ground being walked on.
I have argued the legal consequences of this elsewhere, and they are severe. Here I am after something anterior: not what follows from the citizen’s ignorance, but what kind of act his attempted knowing is.
